Due to the granting of magisterial powers, from now on the army members can make decisions or orders like conducting searches, seizing, and arresting. Previously, the approval of the Executive Magistrate of the private administration was required to take such measures. But now commissioned army officers can take decisions or give orders themselves.
Former Inspector General of Bangladesh Police, Nurul Huda, said that there have been such instances in the past as well. This is not an unusual occurrence.
As a result, the commissioned officers of the army will be able to use all the powers given in the CRPC to disperse illegal mobs, said the former Inspector General of Police.
When informed about the clauses mentioned in the notification, Nurul Huda said, ‘They can be given according to that clause. Commissioned officers can access magisterial power (exercise executive power) when they take charge (assume power). The government is doing it because it thinks it is necessary for the public interest. There are precedents for this.’
He said, ‘Search, seizure (seizure) these powers. Powers are being given to those who need to be searched and arrested in relation to certain crimes.’
