Jamaat-Shibir’s appeal to regain legitimacy

The government is going to withdraw the executive order banning Jamaat-e-Islami and its student organization Chhatrashibir. Jamaat and Shibir applied to regain the legitimacy. In view of this application, it is said that the notification banning Jamaat-Shibir may be canceled on Wednesday or within a day or two. 

Jamaat’s lawyer Advocate Shishir Monir told Samakal that a written application has been submitted with arguments. The government has decided to restore the legitimacy of Jamaat and Shibir. 

Sources in the Public Security Department of the Ministry of Home Affairs said that a hearing was held on Tuesday to receive separate applications of Jamaat and Shibir. It was decided to cancel the decision to ban them. However, it is not known when and where this hearing was held. The file to restore the legitimacy of Jamaat-Shibir with the opinion of the Home Advisor may go to the Law Ministry today on Wednesday. After that the gazette will be published after the final decision of the Chief Adviser. 

The ousted Awami League government banned Jamaat-Shibir on August 1, 2009 under Section 18(1) of the Anti-Terrorism Act. But after this, the 15 and a half year authoritarian rule of Sheikh Hasina collapsed on August 5 in a student-mass coup. Jamaat-Shibir had active participation in this movement of students. Despite being a banned organization, Jamaat has been openly active since August 5 and is participating in all activities including meetings at the highest level of the government. 

In this regard, the Amir of the party. Shafiqur Rahman told various media several times that the Awami League government was illegal. As a result, the notification to ban Jamaat-Shibir is also illegal. 

According to Section 19 of the Anti-Terrorism Act, if the government bans an organization, the decision can be reviewed in writing within 30 days. The government will decide the application within 90 days after hearing it.
